Sorry to thread jack but what would happen if they didn't have insurance? Say they did $25,000 (obviously not the case here), had no insurance, and only had about $2,000 in the bank. Would they still have to pay? Would that debt follow them around or are you SOL? I know most people have uninsured/underinsured coverage but I still don't get how someone without insurance would not have to pay.

As long as you have full coverage insurance, your insurance will pay your claim and try to go after the other individual to cover their loss. In the instance that they cannot get them to pay, you would be out what ever your deductable is. If you dont have full coverage insurance, you would have to take the person to civil court, try to get a judgement, and attempt to garnish their wages. The problem is, most people with out insurance dont have a job, and Unemployment is not something that can be charged with a garnishment.

It depends. If you've got collision on your car, your insurance will cover, but then try to seek damages from the person at fault. Usually they have insurance so their insurance covers...in lieu of that, they're expected to pay.

Of course, since most carry a deductible, and the FIRST dollars go toward the deductible, so to does any dollars recovered....IE, if you've got 5G in damages and paid a 500/deductible while the insurance company covered the other 4500....IF the insurance company goes to court and wins, but is only able to collect 750 dollars, then YOU get 500 and the insurance company gets 250.

In most cases, good luck getting a judgement against the other driver...it's not that you won't, you will. But generally people without insurance will simply declare bankruptcy. This is exactly what happened in my case.

I had less than a week before purchased a 5 year old grand cherokee w/ 65000 miles. Got creamed from behind by a lady driving not terribly old kia sorrento (well, it was newer than my jeep by a quite a bit). Because she had a loan on it, she's supposed to have insurance, right? Nope...heck, she didn't have a license, the vehicle wasn't currently registered, and no insurance....hell, I bet she was months behind on payments and was just happy to see the vehicle out front every morning.

Right after then accident, she declared bankruptcy...so while I received a nice payment for the vehicle being totaled, I was still shorted 500 bucks I was entitled to.

If you are uninsured and the state finds you 50% or more liable you have to pay the damages or make arrangements to pay or you loose your driving and registration privileges with the state of Wisconsin. 49% or less and the uninsured party is off the hook. I've been on the bad end of this, and it's a place you don't want to be.

just got back from picking up the xterra.

not a bad job if i do say so myself. paint is nice and smooth with out orange peel.

looks like i got a mini detail as well.
