View Full Version : Is Milw/DPW responsible for manhole covers/asphalt in your driveway?

I have a manhole cover 2' up my driveway and the surrounding the pavement is now sinking around the cover. Anyone have this happen before? Am I on the hook for fixing the driveway if it occured due to their sewer pipe/manhole? I sent out an email but surprise no response from them.

I think it's safe to assume you'll be provided a half assed fix that makes it worse. lol.

yeah no doubt.

my next door neighbor has a city tree that ruptured his sewage pipe and the alderman says it not their fault but ever 4 months or so the entire basement floods and the estimate he got to repair the broken city pipe was approx $15-$25k.

Ruling is like this. If its a sewer lateral to the house its yours. If its the main its theirs. As far as water service. your responsible for the line from the curb stop to the house. they get the main and the connection to that curb stop. As far as flooding you really need to have sewer back up and sump pump failure clause on your home owners policy. Its only around $ 80 dollars more.

If I understood you correctly the manhole is sinking, but the concrete driveway is not causing a hole in your driveway?

They make spacers that go in the manhole covers to raise them to the proper hieght. Not sure who would install it though. I had Payn & Dolan do ours.

More then likely the the frost heaved the concrete and will self level come spring. However if you do need rings you still have to bust up the create around the frame as the spacer rings go under the frame.

I saw on the news that many of the man hole covers are rising and falling due to freezing ground.. DPW said come spring they should all settle back down into place..
