You do not own pictures you take of your own car.


Recently the Black Mustang Club created a calendar which contained images of club members' cars photographed by the members themselves. Ford didn't take kindly to this and asked CafePress, the service the group had chosen to print the calendars, to kill the project claiming all the images in the calendar are the property of Ford...including the Black Mustang Club logo.

There are professional photographer organizations that do step up to fight this type of abuse by corporations. Advertising Photographers of America is one. If they are lucky enough to have a member that belongs to that organization it is certainly a possibility to fight Ford

Didn't NY city try the same thing a few years ago, trying to gain control of the skyline and any photos of it?

What is the legal ruling on this? What about a photograper that takes a photo for profit of a celebrity driving a Ford or Lincoln?

OK, according to 1st amendment rights, I can take a picture of my Ford and sell those prints as fine art, I can take a picture of your Ford and do the same, heck I can even take a picture of you in your Ford and sell those too, as long as you and your Ford were in public view even if you and the Ford were on private property. What I cannot do is use said pictures to advertise a service or product that would seem like Ford endorses said product or service. BMC could fight this and win.

This same deal happened to me at wistangs when I uploaded photos to Cafepress for printing our 2008 calendars. I received a canned letter from Cafepress, same as what BMC got, stating that my photographs were copyrighted by Ford. That kinda pissed me off.

A few letters back and forth with Cafepress on the issue and now our store is at Printfection(awesome BTW), and all calendars were ordered through my personal photography store and printed by mpix(even more awesome).

Ford should be ecstatic that there's people out there who still give a damn about the company, cause it seems like nobody is buying their cars. To aggravate the last Ford fans is insane. Another case of a company being ruined by lawyers and accountants.
